鸠占鹊巢！加州流浪汉开始抢空房子住了！

但要知道加州政府官员的“出其不意”

只有我们想不到 没有他们做不到

最近他们可是给流浪汉们找到了更好的归宿

游民们不仅有大House住了

还要搬去有自助餐的豪华游轮了！

<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">加州流浪汉开始抢空房子住了！

这个事儿，还得从一套房子说起。

一家名叫Wedgewood的加州地产公司，在几年前，以<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">50.1万美元的价格买下了<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">湾区西奥克兰West Oakland一套房产。

这套房位于Magnolia街，建于1908年，带浴室，面积约1,500平方英尺（约140平方米），长期闲置。

但去年底开始，这套房产开始频频见诸报端，原因是――<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">遭到非法入侵！





之所以引起媒体如此大的关注度，是因为<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">非法入侵者的身份，不一般。

入侵者并无过激举动，是34岁的Walker和41岁的Sameerah Karim，

她们有一个共同的身份是：带着孩子流落街头的单亲<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">游民妈妈。

去年11月为了避免流落街头，她们带着自己的孩子，直接住进了奥克兰街上，这栋闲置的三居室住宅。



两位妈妈表示，这房子已经<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">闲置了2年，她们的无奈之举也是<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">抗议在无家可归流浪危机日益严重的情况下，<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">房产投机客们买了房却闲置不住。

去年底“入住”闲置房产的妈妈们，自然也遭到驱逐，

但她们不仅置若罔闻，还“理直气壮”

表示：<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">反正空着也是空着，毕竟不住这，就只能睡大街。

一副你能拿我咋地的架势~！



一看引起了这么大关注度，这群妈妈似乎发现了其中“玄机”。

还有模有样的成立了一个“维权”组织――<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">Moms4 Housing（为房而战妈妈团）





面对驱逐，“为房而战妈妈团”据理力争，而且已经<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">吸收了百人以上的支持团体。

去年<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">竞选市长失败的奥克兰活动家CatBrooks也表示：

“如果我和孩子都睡大街了，而你却拒绝给我提供住房，还想让我和孩子死在外面不成？绝不！”



<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">“鸠占鹊巢”也有理？！

<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">博部分立法者支持

去年12月6日，Wedgewood加州地产公司，向入住”闲置房产的妈妈们，发出了驱逐令。

于是地产商和游民妈妈的争房大战正式开始，也不可避免地闹上法庭。

谁知竟然真的翻出水花，<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">不仅得到了部分立法者的支持，“妈妈团”还取得了初步性的胜利！





到目前为止，在社区驱逐辩护和法律支持的合力下，这些游民妈妈和她们的支持者已经<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">成功地击退了驱逐。

<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">法官表示：“No Dismissal暂时搁置 ”地产商的起诉，直到他做出最后裁决！

12月30日， “为房而战妈妈团”已经迫不及待的，举行了一场集会，庆祝这一阶段性胜利！

因为这一判决让她们暂时“无负担”的拥有了这栋房子，截止目前，她们依然在这栋房子里快乐的生活着~



她们大声呐喊示威着：

<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">“看看这究竟是谁的房子？Whose House ？”

<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">“是我们妈妈团的房子！Mom`s House！”

她们强调，这些妈妈们不仅仅是在为自己的房子而战，也是在为所有需要住房的人而战。“即使我们赢得了这所房子，我们也不会停止，直到每个人都有房子！”

“妈妈团”方面的律师Leah 为驱逐行为做了辩护：

他<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">要求法庭无论从道德上还是法律上，都应该批准这些流浪母亲拥有空置的房子。

“法律上有先例可以证明，住房是国际法规定下人的一项基本权利，这是法院应该承认的。涉案房屋所在的奥克兰住房危机严重，如果强行驱逐，游民妈妈们将面临无家可归的危险境地，陷入难以维持的生存状况。既然已经有了这样的需求，法院必须并且能够有权进行干预。”



伯克利的<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">民主党参议员NancySkinner，甚至还<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">对这些“鸠占鹊巢”游民妈妈表示出了感谢：

“要感谢Moms 4 Housing利用了这些房子，<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">在加州有住房危机的时候不应有任何房子闲置。<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">无家可归的妈妈占用这些房子完全合法！”



另一位奥克兰市议员Nikki Fortunato Bas也坚定的站在“妈妈团”这一边。

“这就是这些妈妈们所应对危机的正确反应。

”<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">她们“正在做任何一位母亲都会做的事情，以保证孩子们的安全和庇护”。她称这是一场“开放商暴利和贪婪的危机”。

此外，“妈妈团”在法庭之外，也获得了不少人的同情和支持。

支持者认为，“无家可归对年幼的孩子有多么暴力，这是法院在做出决定时应该考虑的。”

<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">住了5年，"空"房子就送你

更让人匪夷所思的是，<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">加州在立法方面，的确让这些游民们的“抢房”，看上去据可查！

加州的确规定了，人们可以随意占领被遗弃的房屋。只要你住进去以后持续交地税，这房子就“白白”送你了！

据加州民法315款-329.5条规定，房子的现住户可以通过一个叫作<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">“逆权侵占”的法律程序(Adverse possession) 接手不属于他们的房子。



在加州，一个擅自占用者，<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">在那里居住一段时间后，可以要求对某一财产享有权利。

他只要在公开占据一处房子里，<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">连续居住或维护5年，就可以提出时效占有要求，他可以<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">合法地获得财产的所有权，将房子转到自己名下。

这样，擅自占用者有合法的许可留在该房产里，<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">不再是非法侵入者，换句话说，这套房子就归他了！

而<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">加州不少无家可归的人，正是利用擅自占用者的权利，在不支付租金或抵押贷款的情况下，获得房屋财产所有权！

这简直细思极恐，

若这法案开了先例，<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">加州游民们，可以游街串巷去找空房子了住了......

有些华人网友也表示，类似“霸道抢房”的案例，也确实在自己身边发生过:

<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">#“因屋主长期住在中国而空置，但近来却搬进一对黑人男女，还在自家后院举办拍卖活动，卖的都是原来华人物主在家中的物品。”



<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700"># “我之前住的小区，就有美国大兵被派伊拉克几年，没有付HOA费（物业费），然后房屋就被HOA给拍卖了。”



这里也给大伙提个醒，如果有房产在加州长期闲置，最好定期派人去查看一下，或者委托房产管理人来管理房屋的维护和修缮。

<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">对我们纳税人的暴击

<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">这是鼓励不劳而获吗？

再来说说这个新闻。

听了游民妈妈团的“卖惨”，不少辛苦工作纳税的加州妈妈们，实在是坐不住了。

来自湾区的Misty Cross说，她<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">一直身兼数职，打了三份工，按时向政府交税，几乎没有时间陪孩子。<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">为的就是确保孩子们有一个稳定的家。

“我身边都是努力工作的妈妈，我们每个人都有两到三份工作，只是为了维持生计。

你现在告诉我，其实还有一种“捷径”：

<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">只要将懒惰进行到底，不仅会被同情，还有免费的大房子住？！"

这样的消息，真的是给我们加州辛苦码砖的纳税人，当头一击！

对于湾区华人来说，现在30万的家庭年收入都是所谓的“贫困线”，其中<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">最大的“致贫因素”，一是交税，另一个就是加州<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">高额房价了。

目前湾区的房价中位数，大约在90万美元，<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">得年薪18.7万才能买得起一栋房子。

面对如此数字，有的中产家庭甚至选择逃离加州......

地产商一边也完全接受不了这一套，认为游民妈妈就是入侵，坚持私有财产神圣不可侵犯：

“<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">这种要求必须被拒绝，入侵者无权拥有房产”，

并且他们认为是游民妈妈们是盗窃行为，视法律为无物。

也是<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">在纵容犯罪，纵容人们盗窃房产。



一边是日益增长矛盾不断激化的游民流浪问题，

另一边有数据现实，湾区目前有多达46,000间空置的房屋，其中不乏全新住宅。

掐指一算，湾区<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">每位无家可归者，可以对应到的空置房产竟有4套之多......

在最近的抗议活动中，游民团体喊出了“提供保障性住房Affordable Housing now”的口号。

按照这些游民的思维，每个人的住房问题都亟待解决，每个人的生存都是基本权利...

那么游民妈妈的诉求之外，学生住房、看门人清洁工住房等等要不要考虑？
流浪汉有点多加州政府考虑包“豪华游轮”给他们住

既然无家可归的游民不能露宿街头，

加州官员又脑洞大开，想出了惊世骇俗的点子――

让他们住游轮上怎么样？





据说是，有一天，奥克兰市议会议长Rebecca Kaplan读到关于<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">飓风营救的文章，<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">突然一拍脑袋，哎呀这个办法太好了！也许可以将救援思路用到咱加州解决游民问题上。

卡特里娜飓风后，前佛罗里达州州长JebBush迅速向嘉年华邮轮公司(GOP)掏了2.36亿美元，签下三艘船来容纳5,000名飓风受害居民，约合每月3,900万美元，<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">包含了每天三顿自助餐，合同为期六个月。

加州市议员一看，这眼下加州庇护床位供不应求、没有自来水和厕所，已经成了人道主义和公共卫生紧急事件。游轮简直是再好不过的救急了！

游轮的方案一经提出，很快有两家邮轮公司与Kaplan取得联系，并提供了完整的方案，计划今年初向当地政府<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">提供1000张船上床位。

此前用游轮做临时安置所也有先例，但谈不上成功。

前加州众议员Henry Waxman在2006年曾写信表示这<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">完全是浪费纳税人的钱。这么一大笔开销，完全都够联邦政府给游民建永久性保障住房了...

议长RebeccaKaplan这样的提议对邮轮公司也不是完全的无稽之谈，之所以有邮轮公司愿意主动来接洽，也是因为国际海事组织（InternationalMaritimeOrganization）2020年起实施了更严格的排放法规，有些邮轮根本不具备再升级的可能，于是也就不如停靠下来挪作他用。

具体费用方面有待商榷，但奥克兰港官员表示，计划中<strong style="-webkit-tap-highlight-color:transparent; box-sizing:border-box; font-weight:700">今年1月商讨无价或低价向游民开放邮轮床位的事宜。
